You agree when you enroll as a participant that you understand that all posts reflect the opinion of the poster, not the opinion of FriendsRecover.com, and that we do not endorse any of the advertisers or their sites, or any third parties or their sites or any of their products, services, opinions, or advice, and in order to participate, you waive your right to hold Friends Recover, LLC and FriendsRecover.com legally responsible for all website matters, and you agree to release, indemnify, and hold harmless Friends Recover, LLC and FriendsRecover.com from any and all responsibility, liability, claims, or lawsuits regarding said website, your participation therein, and any and all matters relating to advertisers and third party users.
    4. THIS FriendsRecover.com WEBSITE IS OWNED BY Friends Recover, LLC, A MASSACHUSETTS LIMITED LIABILITY COMPANY AND BOTH REFERENCES ARE INTERCHANGABLE THROUGHOUT THIS AGREEMENT AND ARE HEREIN REFERRED TO AS "FriendsRecover".
  4. Eligibility: By using FriendsRecover, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older; and (d) your use of FriendsRecover does not violate any applicable law or regulation. Your profile may be deleted and your membership may be terminated without warning, if we believe that you are under 13 years of age.
  5. Term: This Agreement shall remain in full force and effect while you use FriendsRecover or are a Member. You may terminate your Membership at any time, for any reason, by following the instructions on the Member's Account Settings page. FriendsRecover.com may terminate your Membership at any time, without warning. Even after Membership is terminated, this Agreement will remain in effect.
  6. Password: When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify FriendsRecover.com immediately at admin@friendsrecover.com. If you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
  7. Non-commercial Use by Members: FriendsRecover is for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by FriendsRecover.com. Illegal and/or unauthorized use of FriendsRecover, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the FriendsRecover website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles without notice and may result in termination of Membership privileges. Appropriate legal action will be taken for any illegal or unauthorized use of FriendsRecover.
  8. No Medical or Psychiatric Advice: FriendsRecover does not provide medical advice or offer medical or psychiatric opinions. While we will monitor content as time allows, we are not responsible for the opinions, advice, recommendations, advertising or suggestions of any participating member. Anyone who has a medical problem should contact a physician to get medical or therapeutic help. Anyone who feels at risk for suicide should call 911 immediately. The function of this site is simply to allow a circle of friends to exchange opinions and information and nothing more. Therefore, before you create a profile and enter into conversation in a forum, we will require you to sign an acknowledgement that you understand these terms of use and that you forever agree to release, discharge, indemnify, and hold harmless Friends Recover, LLC and FriendsRecover.com, its agents, employees and owners from any and all claims, debts, actions, causes of action, suits, damages, and any and all claims, demands, and liabilities, both in Law and in Equity regarding said Website and LLC in general and your participation therein.
  9. No Offensive Material: As a member of FriendsRecover, we will expect you to follow certain content rules, including the prohibition of any content which is illegal or otherwise prohibited. Illegal or prohibited content would include content which holds itself out as medical or legal advice, which invites other participants to engage in a criminal activity which offers other participants an opportunity to participate in a financial scheme, pyramid, chain letter, or otherwise invites participants to send money to the poster, or which contains sexually suggestive, racially offensive, threatening or abusive language. The right to determine what material offends the online community will be the sole decision of the moderator.
  10. Information We Collect: Use of the Site requires that you create an account with our Site. The process of creating an account requires that you provide us with certain information, referred to herein as "Account Data." Account Data shall include your functioning email address, birth date, desired user name, password, and any other information you may choose to provide in connection with the creation of your account profile.   13. Miscellaneous: We reserve the right to release your information (both Account Information and Passive Information) in the event that:
    1. at our sole discretion if we believe that the Site is being or has been used to commit, or help commit, any unlawful act;
    2. we believe that you may harm, or have harmed, the property or rights of us, the Program's other members or any other third party;
    3. to third parties such as Internet credit processors, server security contractors or other necessary for us to provide you with services, if applicable,;

  18. Third Party Advertisements: We may utilize the services of outside advertising agencies to advertise our services and goods and/or services offered by themselves or by third parties. Either we or our advertising agencies may use cookies and/or "action tags" to measure advertising effectiveness on an anonymous basis. Should you elect to visit any advertiser's website, we cannot and do not make any warranties or representations about products and services or applicable terms and conditions or privacy policies for such advertiser's website.     1. We rely on your representation that you own the content posted by you on our website and/or that you have the right to grant a license for the same. And further that you have not violated any person's rights or any privacy rights, publicity rights, copyrights, and contract rights. By posting on this site, you agree to be responsible for all royalties, fees, or any monies due another.

FriendsRecover.com does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, "Content") that you post to the FriendsRecover website. After posting your Content to the FriendsRecover website, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose. If at any time FriendsRecover.com chooses, in its sole discretion, to monitor, FriendsRecover.com nonetheless assumes no responsibility for the content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.
    2. You are solely responsible for the content that you post on or through any of the FriendsRecover website and any material or information that you transmit to other Members and for your interactions with other Users. FriendsRecover.com does not endorse and has no control over the Content. Content is not necessarily reviewed by FriendsRecover.com prior to posting and does not necessarily reflect the opinions or policies of FriendsRecover.com. FriendsRecover.com makes no warranties, express or implied, as to the Content or to the accuracy and reliability of the Content or any material or information that you transmit to other Members.
  21. Content/Activity Prohibited: No illegal or harmful contact or activity is allowed to post on or through the FriendsRecover website. FriendsRecover.com reserves the right to investigate and take appropriate legal action against anyone who, in FriendsRecover.com's sole discretion, violates this provision, including without limitation, removing the offending communication from FriendsRecover and terminating the Membership of such violators.

All material created for this website, including software, design, language, and the FriendsRecover name and logo, is protected by copyright, trademark patent, trade secret, and any other applicable laws. You may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell the contents. The term "User" refers to a Visitor or a Member. You are only authorized to use the FriendsRecover website (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement.     Also, in no event shall Friends Recover, LLC and FriendsRecover.com be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages with regard to your membership, use, or participation in this website.
  6. You agree that this Agreement shall be binding, not only on you but also upon your heirs, successors and assigns, fiduciaries and personal and legal representatives.
  7. U.S. Export Controls: Software available in connection with FriendsRecover (the "Software") is further subject to United States export controls. No Software may be downloaded from the FriendsRecover website or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk.
  8. Disputes: If there is any dispute about or involving the FriendsRecover website, you agree that the dispute shall be governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in the Commonwealth of Massachusetts and/or the City of Waltham. The failure of Friends Recover, LLC and FriendsRecover.com to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. FriendsRecover.com is a trademark of Friends Recover, LLC. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void, or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
